For a new client we have challenged the excessive rent for an apartment in Berlin-Moabit (Emdener Straße). In this stepped rent tenancy, the net cold rent is around €520 – under the Berlin rent index 2024, however, only around €330 is permissible. The agreed rent is thus roughly one third above the statutory maximum.
On this basis we have pursued a reduction to the permissible level, repayment of overpaid amounts and a proportional refund of the excessively high rental deposit. In parallel we are pursuing a rent reduction due to several defects in the apartment – in particular damp and mould, a cellar compartment included in the lease but not usable, and a front door that was defective for months. In total, repayment claims of around €1,500 are currently at issue; we have also demanded proper remedial works, disclosure of the facts relevant to rent law (§ 556g BGB) and reimbursement of out-of-court costs.
The matter is still at an early stage. We have set the landlord a short deadline to respond and are expressly seeking an amicable resolution. The next steps will of course be determined by our client in close consultation with us, and we will explain all relevant legal and financial advantages and disadvantages, including any cost and litigation risks.
