€1,460 net cold rent for about 70 m² in a simple residential location: for two clients we have challenged the rent of a flat in Cambridger Straße, Berlin-Wedding. That is €20.86/m².
On our provisional calculation against the Berlin rent index 2026, only €595.21 per month is permitted. The rent is therefore about €864.79, or 145%, above the statutory maximum – the clients are paying almost two and a half times the likely permissible rent.
Because the objection was raised in time within the first 30 months of the tenancy, we are claiming the overpayments retrospectively from the start of the tenancy. Up to and including August 2026 that is €8,215.50 of overpaid rent and €2,594.37 of overpaid deposit. In total, €10,809.87 is already at issue. Each further month adds €864.79.
No exception to the rent cap is apparent at present: according to the landlord there was no prior rent, and the building was already erected in 1960. The alleged comprehensive modernisation was not notified to the tenants in the legally required text form before the contract was concluded. A comprehensible breakdown of the works and costs, deducting repair and maintenance shares, is also still missing.
Partial furnishing does not support the rent either. No separate furnishing surcharge is stated; several appliances were, according to the lease, merely made available free of charge. The contract expressly sets €0 for the parking space.
The landlord’s reaction so far is striking: instead of producing the evidence requested, she approached the tenants personally despite purported legal representation. Her settlement proposal of €1,300 net cold sounds like a concession, but would still be €704.79 above the provisionally determined maximum – still more than double that figure.
Our clients remain interested in a reasonable out-of-court solution. A settlement must, however, adequately reflect the extreme rent excess and the repayment claims already accrued. The matter is not yet concluded; we will report on further progress.
